Affirmative & Defensive Asylum
- A form known as I589 must be submitted by applicants to the USCIS.
- The candidate must be in the United States at the time of application.
Within a year after the applicant’s arrival, this must be lodged.
- The applicant needs to be involved in the immigration courts’ removal proceedings.
- In the event that the applicant asked for affirmative asylum and was referred by the USCIS, their application was already submitted to the immigration judge.
- The applicant will present the immigration judge with their defending application.
The petitioner should submit an affirmative asylum application if they haven’t started a formal removal procedure.
Things to be aware of before applying:
- The applicant should answer in the affirmative if the removal procedure has not yet begun.
- Additionally, the applicant should take a defensive stance if the removal procedure has begun.
- An applicant must be regarded as a refugee in order to be eligible.
- To apply, a person must be in the United States.
- The defensive asylum process starts the moment the USCIS rejects the affirmative.
